This is the last Will and Testament of me Thomas Daykin of Dyke-heads near Gunnerside in the township of Melbecks parish of Grinton and North Riding of the County of York Farmer made the fourteenth day of May in the year of our Lord one thousand eight hundred and seventy three

I hereby appoint William Heseltine of Gunnerside Flourdealer and James Thompson of Thistlebout in Melbecks aforesaid Farmer the Executors of this my last Will and Testament and I give to the said Executors all my real and personal property whatsoever and of whatever kind which may or ought to belong to me at the time of my decease In trust nevertheless for the following purposes that is to say I desire my said executors to sell all my Farming Stock Dairy Utensils Husbandry Gear Household Furniture Cows Carts or Cart within twelve months after my decease and the money arising from said Sale they shall add to all the money left by me at the time of my death and after paying all my just and lawful debts my Funeral expenses and the proving of this my last Will and Testament out of said money then they shall dispose of the reminder as follows not later than twelve months from the day of my death

To each of my Executors I give the sum of Five pounds (£5-0s-0d) and then what money remains shall be paid at once in equal shares to the following persons

To my nephew John White of North Field Boldron one full share

To my niece Rosamond Roberts of Barnard Castle one full share

To my nephew Metcalfe Daykin of America one full share

To my nephew John Thomas Daykin of America one full share

To my Nephew George Washington Daykin of America one full share

To my niece Phyllis Fawcett of America one full share

and to Jane Raw my servant one full share

I also desire my Executors to keep my copyhold property at Ivelet in the Township of Muker parish of Grinton and North Riding of the County of York aforesaid in good tenantable repair said property consisting of a dwellinghouse with the appurtenances thereunto belonging and two parcels of land known by the style or title of East Ing a meadow and the other called the Gill all situate at Ivelet said property having a right to six Cattle Gaites in Ivelet Pasture and to twenty one stints for sheep on Ivelet Moor

my said Executors shall let the above named property at Ivelet to proper tenants and shall receive the rents which they shall pay every half year at Lady day and at Michaelmas [sic] to my brother John Daykin to himself for his sole use and benefit during his lifetime and at his death I give to my two nephews Metcalfe Daykin now of America and George Washington Daykin now of America the whole of the above named property at Ivelet to themselves absolutely and to their heirs for ever

I also give the third share of the property at Gunnerside and Lodge Green which formerly belonged to my late father Jonathan Daykin which property consists of one dwellinghouse and Stable and two fields called Winterings Fields all in the territories of Gunnerside the said third share of said property being given to me by my said Father on the death of my brothers Jonathan Daykin and John Daykin and which I hereby desire to be given to my Nephew John White and to his heirs for ever And this I declare to be my last Will and Testament revoking all other or former Wills

In witness whereof I have hereunto set my hand this fourteenth day of May in the year of our Lord One thousand eight hundred and seventy three in the presence of two subscribing witnesses

We the undersigned have attested the execution of the foregoing writing by Thomas Daykin by him signing the same as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other all being present together and signing at one and the same time and place have hereunto subscribed our names as witnesses this fourteenth day of May in the year of our Lord One thousand eight hundred and seventy three
